Terms of Sale and Use of myVTC

 

1. About us

The company MY VTC, EURL, with a capital of 1,000 euros, whose registered office is at OSTWALD (67540) 1 Allée de la Roselière, registered with the trade and companies register of OSTWALD under the number 840 316 269 represented by Mr Anthony MASSINI (hereinafter the “Company”) The Company offers the following services: Passenger transportation by taxi.

2. Preamble

The Company invites its Users to carefully read these Terms and Conditions of Sale and Use (hereinafter the “GTC / GTC”). The GTC / GTC apply to all Services provided by the Company to its Customers of the same category, regardless of the clauses that may be listed on the Customer’s documents and in particular its general conditions of purchase. The GTC / GTC are systematically communicated to the Customer who requests it. The Customer is required to read the GTC / GTC before placing an Order. 5. Service Provision and Price


The Services subject of the GTC / GTC are those which appear on the Website and which are offered directly by the Company or its partner service providers.

6. Orders


The Customer selects the Services that he wishes to order, either by telephone (03.88.28.07.50), by e-mail (my-vtc@orange.fr), via our website (www.myvtc.fr).
Any Order via the website can only be performed when the User has registered on the Site. the User, when logged into his account, can add Services to his virtual basket. He can access the summary of his virtual basket in order to confirm the Services he wishes to order and carry out his Order by pressing the “Order” button.
He must then enter his address, the method of delivery and a valid payment method to finalize the order and effectively form the sales contract between him and the Company.
The registration of an Order on the Site is made when the Customer accepts the T & C by checking the box provided for this purpose and validates the Order. This validation constitutes proof of the sales contract. The finalization of the Order implies the acceptance of the prices and terms of performance of the services as indicated on the Site.
The reservation must take place at least one hour (1) before the start of the transport service (this period may be increased at the discretion of the Provider depending on the availability of vehicles).
Once the Order has been placed, the Customer will receive confirmation by email. This confirmation will summarize the Order and information related to the performance of the service (s).
In the event of a payment default, incorrect Customer address or other problem on the Customer’s account, the Company reserves the right to block the Customer’s order until the problem is resolved. If unable to perform the service, the Customer will be informed by email to the address he has provided to the Company. Any modification of the order by the Customer during the performance of the service may result in surcharges to be paid to third parties or refund to the driver at the end of the service. The acceptance of a modification of the order initiated by the Customer during the performance of the service will remain at the discretion of the Provider who may refuse it if it causes a disruption in the operation of its organization.
The Company may grant the Customer discounts, discounts and rebates depending on the number of Services ordered or according to the regularity of the Orders, according to the conditions set by the Company.

The wearing of the belt is mandatory. The customer is forbidden to leave the head outside the vehicle while driving. The driver reserves the right to condemn the windows.
Baggage or any other property of the Client remains under his responsibility. The Service Provider can not be held responsible for theft of valuables and luggage left in the vehicle.
For reasons of safety and respect of the vehicle, only the driver is able to open and close the doors.
The Customer agrees to maintain a correct attitude, not to consume drugs, not to get drunk and generally adopted an attitude in accordance with good morals.
The service may be refused if the Customer is alcoholic, violent or disruptive.
Food and drinks are not allowed on board the vehicle except those made available to the Customer by the Service Provider.
It is forbidden to film the driver unless authorized.
Animals are forbidden on board vehicles, except for blind persons after confirmation.
The Service Provider reserves the right to refuse the performance of the service if it does not correspond to the description that was made when ordering by the Customer, such as moving, taking packages that could damage the vehicle (bag cement, plaster, etc …). In the latter case, the service will be cashed in full and no refund will be made.
The Customer agrees to inform the Provider at the time of ordering the need to install a baby seat in the vehicle in the hypothesis of transporting children or babies. For this purpose, the Client communicates to the Provider the age and weight of the child or baby so that the seat is adapted and complies with the applicable regulations regarding the transport of children or babies. If the information provided by the Customer is incorrect or absent regarding the presence of children or babies to be transported, the Service Provider reserves the right to refuse to perform the service. In any case, the service will be refused if the indications given by the Customer at the time of the order did not allow to adapt the vehicle to make it complies with the regulations on the transport of children or babies.
The Customer agrees to inform the Provider of the existence of luggage weighing more than 25 kg. The Service Provider reserves the right to refuse to load the trunk with unsuitable baggage or bags.


9. Claim


For all Orders made on this Site, the Customer has a right of complaint of 2 from the provision of the Service.
To exercise this right of complaint, the Customer must send to the Company, at the address my-vtc@orange.fr, a statement in which he expresses his reserves and claims, together with supporting documents relating thereto.
A claim that does not comply with the conditions described above can not be accepted.

10. Right of withdrawal of the Consumer

17. Intellectual property
